1. Introduction

This is the Level Zero VR Virtual Reality Participation Agreement, Assumption of Risk, and Release of Liability (this "Agreement"). It applies to the participant named on this form ("Participant") and, if the Participant is under 18 years of age, to the parent or legal guardian signing on the Participant's behalf. By signing below, you are agreeing to legally binding terms that affect your rights, including your right to sue Level Zero VR in certain circumstances. Please read this entire Agreement before signing.

2. Assumption of Risk

Virtual reality ("VR") activities require physical movement while wearing a headset that limits or blocks the Participant's view of the real, physical space around them. I understand and acknowledge that VR activities at Level Zero VR involve inherent risks that cannot be eliminated regardless of the care taken to avoid injury, including but not limited to:

• Slips, trips, and falls;
• Collisions with walls, equipment, furniture, or other participants;
• Loss of balance;
• Motion sickness;
• Dizziness;
• Nausea;
• Eye strain;
• Fatigue;
• Disorientation;
• Minor or serious injuries; and
• Equipment malfunction.

I voluntarily assume all such risks, known and unknown, for myself or, if I am signing on behalf of a minor Participant, on that Participant's behalf.

3. Medical Warning

Participation in VR activities may not be appropriate for individuals with certain medical conditions. Participation may not be appropriate for individuals with:

• Seizure disorders;
• Epilepsy;
• Heart conditions;
• Pregnancy concerns;
• Vertigo;
• Severe motion sickness;
• Medical conditions affecting balance or mobility; or
• Any other condition that could be worsened by VR use.

Level Zero VR staff are not medical professionals and cannot assess whether it is safe for any individual to participate. The Participant, or the Participant's parent or legal guardian, is solely responsible for deciding whether the Participant is medically able to safely participate, including by consulting a physician beforehand if there is any doubt.

4. Safety Rules

By participating, I agree that the Participant will:

• Follow all instructions given by Level Zero VR staff;
• Stay within the designated play area at all times;
• Stop immediately if instructed to do so by staff;
• Immediately report any dizziness, discomfort, or symptoms of motion sickness to staff;
• Use all equipment properly and as instructed; and
• Respect other participants and staff.

5. Equipment Responsibility

I agree that the Participant will treat all headsets, controllers, cables, and other equipment provided by Level Zero VR responsibly and as instructed. I agree to immediately report any damaged or malfunctioning equipment to staff rather than continuing to use it or attempting to repair it.

6. Release of Liability

To the fullest extent permitted by applicable law, I release, waive, discharge, and covenant not to sue Level Zero VR, and its owners, employees, contractors, agents, affiliates, and representatives (collectively, the "Released Parties"), from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, expense, or injury — including death — that the Participant may sustain while participating in activities at Level Zero VR, whether caused by the negligence of the Released Parties or otherwise, except where such liability cannot legally be waived under applicable law.

7. Parent / Legal Guardian Consent

Participants under 18 years of age must have a parent or legal guardian complete and sign this Agreement on their behalf. If the Participant is under 18, the parent or legal guardian signing below:

• Must provide their full name and relationship to the Participant, entered further down on this page;
• Confirms that they have the legal authority to sign this Agreement on the Participant's behalf; and
• Agrees, on behalf of both themselves and the minor Participant, to all terms of this Agreement, including the assumption of risk in Section 2 and the release of liability in Section 6.

8. Emergency Medical Authorization

I authorize Level Zero VR staff to contact emergency medical services on the Participant's behalf if staff believe it is necessary. I understand that the Participant (or, for a minor Participant, the Participant's parent or legal guardian) remains solely responsible for any costs or expenses arising from any medical treatment provided to the Participant.

9. Personal Property

Level Zero VR is not responsible for any personal property that is lost, stolen, or damaged while on the premises.

10. Governing Law

This Agreement shall be governed by the laws of the state in which the Level Zero VR location you are visiting operates, without regard to its conflict-of-law principles.

11. Severability

If any provision of this Agreement is found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of this Agreement shall remain in full force and effect.
